As part of Copyright Week 2026, the Electronic Frontier Foundation (EFF) highlighted a broken aspect of U.S. copyright law: statutory damages. These are fines imposed on platforms and users for copyright infringement, and because there is little guidance on how to calculate them, they can far exceed the amount of actual financial harm—up to $150,000 per work. For the many internet users whose online presence relies on re-use, this creates steep risk and encourages online censorship.

Massive, unpredictable damages awards for copyright infringement, such as a $222,000 penalty for sharing 24 music tracks online, are the fuel that drives overzealous or downright abusive takedowns of creative material from online platforms. Capricious and error-prone copyright enforcement bots, like YouTube’s Content ID, were created in part to avoid the threat of massive statutory damages against the platform. Those same damages create an ever-present bias in favor of major rightsholders and against innocent users in the platforms’ enforcement decisions. And they stop platforms from addressing the serious problems of careless and downright abusive copyright takedowns. […]

“But wait”, you might say, “don’t legal protections like fair use and the safe harbors of the Digital Millennium Copyright Act protect users and platforms?” They do—but the threat of statutory damages makes that protection brittle. Fair use allows for many important re-uses of copyrighted works without permission. But fair use … can sometimes be difficult to predict when copyright is applied to new uses. Even well-intentioned and well-resourced users avoid experimenting at the boundaries of fair use when the cost of a court disagreeing is so high and unpredictable.

The EFF proposes a fairer system: limit statutory damages to a multiple of harm or eliminate them altogether in cases of good-faith fair use.

The EFF has a long history of tackling problems in U.S. copyright law. In 2008, with support from the OTW, the EFF petitioned the U.S. Copyright Office for an exemption to the DMCA’s anticircumvention provisions in order to allow noncommercial remix artists, such as vidders, to break DVD encryption for the purpose of obtaining short, high quality clips for inclusion in noncommercial remix videos. The EFF and the OTW, along with New Media Rights, continue to file renewal petitions to keep this exemption active.


The OTW received a request from an Advanced Placement high school student who is conducting a study about the effects of fanfiction and fandom on interpersonal development. To take part in this study, fans can answer a survey about the fandoms they are involved in, the fanfiction they read, and their experiences interacting with other fans. But no, not an hour ago she walked right up to my door, determined as you please, and I do believe she intends to stay despite how the whole damned ruck of Stirlings must be throwing a tantrum as we speak. The spunk of the girl! The ways of Providence are strange.”

Life was full of surprises, but in Barney’s experience, people generally weren’t. Oh, people had surprised him before, in his callow youth, but that was because he hadn’t understood who they really were. Once you got down to someone’s true character, you could see that they’d been who they were all along. People mostly kept doing just what they’d been doing their whole lives, what they’d been brought up to do. Of course he’d met a handful of those who bucked tradition and struck out on their own, but he hadn’t expected to find one in Deerwood.

mirepoix (mir-PWAH) - n., a mixture of diced vegetables, such as carrots, celery, and onions, plus herbs, and sometimes ham or bacon cooked at low heat in oil or butter.


Mirepoix is the flavor base for many dishes in French cooking (much as sauteed or stir-fried onions are in mine). It is named after Gaston-Pierre-Charles de Lévis-Lomagne, duc de Mirepoix (1699–1757), whose name is often shortened to Gaston de Lévis, duc de Mirepoix, an ambassador of Louis XV, but exactly what his connection is, dictionaries don't mention, and I'm too tired this morning to dig further.

Reading and laughing

I went to bed at a reasonable time yesterday evening and started a new book with delighted anticipation. "Reading time! I'll get to fall asleep peacefully with my brain tummy full of stories <3" I thought. The way my tbr pile works is that I add recs to my library queue and most of the time by the time the book gets to me 1) I've completely forgotten what it was about and 2) there's a good chance I'll enjoy it because I did add it based on a rec that intrigued me to start with.

To set the scene further: in winter, the cat often climbs onto my stomach while I read because the blankets are thicker and fluffier.

ALAS! The book I started was Skye Falling by Mia McKenzie!!! I'm only about 70 pages in AND I LAUGHED SO HARD!! SO HARD!!!! Poor cat quickly abandoned me since it must have felt like a rodeo machine thing up there, but I was nearly crying and my non-existent abs were aching by the time I stopped reading.

Not the most restful way to fall asleep, I'll be honest. But oh my god. As much as I sometimes wince with some of her specific choices, Skye's internal voice is just. Just. Incredible. I'm not finished yet so no spoilers please :D But I'm fairly sure I picked up the rec from someone here so thank you to whoever mentioned it on their journal :D Wow. Like I laugh and cry and gasp often when reading, but I can't remember the last time I was non-stop guffawing like this from a book.

Edit: Finished the book and I stand by my rec! (The cat had to endure another round of stomach rodeo but I'm sure given time she will find it in her generous (?) heart to forgive me.) The book jacket says the story is about the complexities of family, queerness, race, and community. Definitely! It felt like a love letter to Philadelphia as well (I've never been). Impeccable narrator voice. Black queer woman protag. Many excellent relationships between women. And did I mention how much I laughed? I did. Though it doesn't mean the story isn't poignant or painful, sometimes even while laughing.

And there is about 6 inches of snow which is relatively less than we were expecting right? But there is a thick layer of sleet ice between the snow. Someone plowed the drive some but obviously not near the cars. It's a thick snowbank there and ontop my car is several inches inside an ice shell that I have to get off because if I don't and it blows off it will shatter a windshield of anyone behind me. It's dangerous.

The ice is holding me up as I jackhammer this stuff off the roof of my CR-V...until it didn't. Naturally it gives out on my bad leg side so down I go onto my bad knee and shoulder. My head hits and my hat takes off. It takes a second to realize that was a cushioned fall and I'm fine. My knee bent the natural way so I didn't hurt it (and at this point I can't damage the cartilage more. It's gone) My next thought is, well glad no one saw that. I crawl to my back car door because I will need a handhold to get that bad leg under me on the ice. Had to look like a walrus trying to get up on the rocks to wave to the crowd.

My pants are covered with ice. Ditto my wool pea coat. I get my hat and at least my glasses didn't break. I finish cleaning the car. The ice breaks again but under my left leg so I could catch myself. It takes an hour to do this. Roscoe the three legged mini chichuahua races out to yap at me. I talk to his mom who is furious that the cleaner only cleaned in front of HER apartment and not the other three buildings. She gives me the rest of the salt so I deal with that

My knee is sore. My shin has a goose egg because the blood thinners made a big-ass hematoma but otherwise, I have bruises on my ribs/arm/shoulder but nothing bad. BUT my county and the county the school is in are both still at level 2 snow emergency so no school tomorrow either. I.e. we ran out of salt to fix the roads so we're fucked.




That's the ice sandwich I was walking on and knocking off my car. I otherwise did nothing else I said I was doing today but did get distracted by [profile] 3sentenceficathon somebody come slap me.

For Fannish 50 I had a few things I wanted to talk about but now I'm forced to deal with fans needing a good grip on reality. Between Hazbin Hotel, Helluva Boss, the Mighty Nein and the Amazing Digital Circus, it has to be said, YOUR head canon is just that. Yours. You don't get to threaten the creators when actual canon doesn't match it. You can disappointed sure. You can even quit the fandom. But nothing gives you the right to threaten the creators, the voice actors and other fans. I keep having to write this same blog post time and again (not that the ill behaved members are going to see it).


One of the big name Huskerdust fans quit in a huff (no threats, just they're done). I was wondering who'd be the next BNF (not me, my stories don't seem to hit well in this fandom for the most part but I have a small loyal following that I appreciate) but they're basically 'if you're following me for the fandom might as well unfriend me now. I refuse to have anything to do with this because...basically it didn't match their head canon and they'll be deleting stuff.

Have you ever done this? I mean I'm sure we've all quit a fandom for various reasons. I hated what Marti Noxon did to Buffy the Vampire Slayer and I didn't see half of S6 of Buffy and most of S7 (I only watched a tiny part of it knowing it was the end and I hated what I saw) Ditto the last season of Angel and part of S3 of Angel. I've faded away in other fandoms. What I haven't done is get so mad that fandom didn't match my head canon that I deleted my profiles, erased my stories etc.

I'm not saying that it's wrong. That's something personal to you (not like the death threats and other threats of violence I'm seeing) But I'm curious if you have gotten that mad, why did you feel compelled to delete it all? (Then again I've known some people who have deleted everything just because).

Hey everyone! I wanted to write something after being busy these past few weeks accompanying my mom through her thyroid surgery.

The past weeks have been stressful as my mom underwent thyroid surgery. Afterward, she needed to spend three exhausting days in the ICU because her condition had worsened. My siblings and I took turns staying with her, which left me pretty tired, but I’m grateful she was able to leave the ICU quickly.

I also felt really bad for the elderly men and women in the waiting room who had had family members in the ICU for more than two weeks. I genuinely wish the best for their loved ones and hope they can be moved out of the ICU soon.

Right now, I’m staying at the hospital to accompany my mom. So far, her condition is okay, although she won’t stop coughing. We’re currently waiting for her doctor's assessment, and I really hope it's good.

Also, the hospital she’s staying at kind of sucks, the nurses are unprofessional despite it being a national cancer hospital, and we didn’t use national health insurance because the waiting list would’ve been way too long, and my mom was already feeling really uncomfortable as her thyroid nodule kept getting worse. On the plus side, one of the best oncologists is based at this hospital, so there’s that, I guess.

Anyway, I’m kind of stuck here just accompanying my mom and playing games on my laptop, lol. Thankfully, I downloaded a number of games for my emulator.

I’ve been playing Pokemon Moon and Bravely Default on the 3DS. I never had the chance to play Moon before, so that’s been nice.

Hopefully, my mom can be discharged tomorrow as her condition is holding steady.

Judge My Upcoming Baihe TBR!

New year, new list of reading choices to be judged! The candidates this time are:

  • The Flame Tree (凤凰花, pinyin: fenghuang hua) by Jue Ge (绝歌). Jue Ge has been writing on JJWXC since 2008, and is still actively publishing. Her yanqing novels seem to be somewhat better known, but she's written a lot more baihe than yanqing. I've been meaning to read something by her for a while. To continue my education in old-school baihe (and also because this novel is a reasonable length), I've decided to start with her 2009 CEO romance The Flame Tree.
  • An Incantation for Subduing a Dragon (降龙诀, pinyin: xiang long jue) by Shi Wei Yue Shang (时微月上). Protagonist Luo Qingci transmigrates into a xianxia novel and into the body of (draconic) female lead Ruan Li's evil, conniving shizun. After being put off by the length for years, I decided to take the plunge.
  • Time (时光, pinyin: shiguang) by Ning Yuan (宁远). Supposedly her realist tragic masterpiece. Looking forward to having my heart ripped out.
  • Calming the Wind and Waves (定风波, pinyin: ding feng bo) by Yu Huan (于欢). Yu Huan has a pretty good, though niche, reputation as an author of fairly serious historical novels with political themes. Again, I've been meaning to read her for a while and been again put off by the sheer length of her better-known novels. I've picked this title (which clocks in at a more manageable 543K words) to give me a taste of her work and see if I want to invest my precious reading time in something longer. Plus point: this is set in the Tang Dynasty, during Wu Zetian's reign.
  • 365 Ways of Surviving at a High Difficulty Level (三百六十五种高难度活法, pinyin: sanbai liushiwu zhong gao nandu huo fa) by Mo Ran Piao (莫然漂). Thriller that seemingly begins with one of the leads in a psychiatric institution. Holdover from the last iteration of the TBR pile as I simply couldn't find the energy to read something that was 712K words long. Second time lucky, hopefully!
  • Song of the Peach Blossom (桃花曲, pinyin: taohua qu) by Ruo Hua Ci Shu (若花辞树), a historical romance between a raised-as-a-boy prince and her consort. I pre-ordered the Taiwanese print edition of this and it has just shipped, so I'm keen to read it. And also to confirm a Theory I have about the author's very specific kink (well not that specific as I'm sure quite a lot of people have the same kink, but still.

But honestly why are all the interesting-sounding novels so. Long.
